if you have EAD and 140 is approved (And 180 passed since 485filed), then why are you worried about H1 status ?
am I missing something here ..I let my H1 expire and am using EAD now.

GC is fo future employment so technically you need to have an employment offer when your GC is ready for approval. You can be unemployed up to that date, there is no requirement for continuos employment.

I did spoke with Sheila Murthy Lawyers on chances of maintaining GC processing and Consular processing.
My firm is OK with my long Leave of Absence...Only thing that threw spanner in the wheel was comment from Sheila Murthy firm's advise.
Per them, to renew AP and EAD, I need to be phsically back in states and also stay in States for the duration of approval i.e. if it takes 3 months for renewal of AP and EAD, then I need to be in States for that duration.
I asked them what if I can apply 5months in advance, from Outside US and someone can fedex it to me. Max I can come back for few days.
.. Per them this will not work...
What do you guyz say ?

I don�t think you need to be here from the day you apply AP to the day it get approved. If what I think is correct then I have one idea for you.
1) Now you can go out of USA on first AP, which is already approved
2) Come back for few days to apply 2nd AP again (6 moths before Current AP will expire)
3) Once you apply 2nd AP, you can go France again with first AP and then come back to US before first AP will expire.
4) After few days again you can go France with 2nd AP.
Since your PD is old, most probably you will get GC approval before 1st AP will expire.
This is just an idea but not sure how feasible it is.

I have a 4 yrs BE (ECE) degree. so am not sure what could be the RFE. Do we also have to submit education evaluation for a 4 yr BE degree from Ind?
also since its a govt organization, my LC juz said 4 years bachelors or equivalent. i do have a Masters from an US state university. so not sure what could be the RFE.. ability of pay is not an issue i guess, cos its govt. what other rfe's are there?

Technically, as per regulations, "home" means last known foreign address (8 CFR Section 214.2 h.4.iii E).

Sorry, I am really having tough time coming to IV these days.
Its law the day when it is signed by the president unless there is clause in the bill to postpone the impelmentation.

Guys,
Its quite a gathering out here who have shown some interest or support for the Green card issue for the PhDs. I see numbers increasing slowly. I am networking and try to get more PhDs involved and become aware of the PACE Bill. Friends from many universities are contemplating the line of action to get a change in the language as well as to include the current PhD students/PhD holders in getting benefits from the bill.
I and my friends have drafted a letter and will be sending to our senator (Allen Specter) very soon. It will be great if many more enthusiasts come out and show their support / give their suggestions openly.
So lets keep it rolling.

The processing date for I -485 EB at nebraska is July 30 2007.
And it happens that my I-485 'Receipt date' is July 30 2007 too ! My notice date is 'Aug 31 2007'
So my question is should my case be logically eligible for processing at nebraska center now that we are in March and my PD is current for March. Or do the processing times at service centers represent notice date and not receipt date (I noticed that in my online case status it states "On August 31, 2007, we received this I485 APPLICATION "....which seems logical since the notice date represents the date when info is entered into computers )
As I mentioned earlier in this thread my I-140 is also already approved.
Is there a number I can call to check with USCIS customer service whether they opened my case for adjudicating it. The only immediate blocker I see now is whether or not I am past the 180 days FBI namecheck as well . Hopefully the USCIS cust rep can tell me that info over the phone. How many of years of experience is required for this position. Does it require 10 years of experience. Usually USCIS asks for exp.letters for those years that are mentioned in the requirement. I dont know why they are asking for all 60 months .

First of all, thanks for your time and any suggestions you can provide for me to handle my case.
Here are the details:
- I am employed with a mid-size consulting/services company.
- Perm approved in EB2 and I140 filed 11/2009. I have a BE degree and 9 yrs of progressive experience before perm filing.
- Earlier this month I received an RFE asking for '60 months of exp before labor filing in form of document from current or previous employer'
- All my EB2 qualifying experience is with previous employer(a top 10 Indian IT company) as labor was filed by my current employer the same month i joined them. I was with them for 5.5 yrs
Problem:
- I was on an onsite deputation from Indian company. Before leaving for US they make you sign a bond of approx $10k and the condition is for you to return back and resign. I know that as per US laws this is not enforceable but in India this very much stands true and if you wish to fight it out you need to go thru legal systems, may not be worth the time and energy dealing with a big corporation.
- Considering the heavy amount being asked i had decided not to close my case with them as there was no impact working here in US.
- Now I need an experience letter and they are taking there own time to process my case. I doubt I can get exp. letter from them before due date of my RFE.
Possible solutions based on my knowledge:
- Get a letter on previous company letterhead from some known manager. Contacted some managers but no one seems to willing to do this.
- Get affidavits from co-workers who worked with me during the time. Already have them and had submitted to company lawyer alongwith previous co. offer letter, yearly appraisal letters and last few pay stubs. Basically, everything to prove my 5.5 yrs of work exp. was provided with the only exception of an exp. letter from previous company on its letter head.
Has anyone of you came across this scenario? How did you handle this and what papers did you provide ? Please share your experience and suggestions.

you can find another employer, port your PD to them. While you work for them on EAD, you can file 485 for your wife when ur dates become current again. Hope this clarifies things.

your H1 is out of status.
you can find another employer, port your PD to them. While you work for them on EAD, you can file 485 for your wife when ur dates become current again. Hope this clarifies things.

basically, there are lot of people on the other site, who don't want to join iv but participate:) they think that they might be accidentally causing a benefit to iv by joining iv:)

Such attitude is Worthless! How confident should we be that they will stick to the message and not go of on tangent in the meeting? It may be better off not to have them.
If people believe a cause is worthwhile and will benefit them, they will come - and registering will not be an issue for them.
If people don't want to do the heavy lifting, they will give any excuse - including registering as the detractor to join the cause. The change has to come from within and cannot be forced. You can talk to a person who has a question on what needs to be done during the advocacy days, you can talk to a person who has doubts - if he/she can be reasoned with, but you are wasting time with people who have no intention of participating to begin with!
