Hello all, please share your thoughts/advice on my case.
Worked for Employer A from May 2004 - April 2007
I-140 approved for Employer A in January 2007 (EB2 Category)
Changed job in April 2007 to Employer B (my current employer).
I-485 filed in July 2007 using approved I-140 from Employer A, and a letter for future employment.
Employment verification RFE received in June 2009
My lawyer advises to use AC21 and provide employment verification letter from my current employer (Employer B) for this RFE response.
Since my I485 filing was based on future employment and I did not work for Employer A for 180 days after filing I-485, this causes some complexity.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

I-140 belongs to the employer only, so it is up-to them to disclose the details. Unless you change employer without using AC21 clause, I-140 details won't be necessary.

I am travelling to India and I have got AP. I also have an I-94 when I arrived last time to US. This is expired and I also have a I-94 with my last H1b (expires in June 2010). Now, I am working on EAD.
My question is which I-94 I need to return to the Airlines while boarding the flight?
Also, I am starting my flight from Cincinnati to Washington. From Washington I have a connection to Dubai and then to Chennai. Where should I submit my I-94?

I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)

I entered in USA on H1B with Company A. Transferred H1B from A to B and B to C in last three years. Not even spent single day at Company D. Now, Company D is suffering from 2008-2009 worst recessions and about to get close in one month. They already informed me. What are the options to get green card with as less risk as possible?

This is all the list i follow...
Copies of ALL degrees and transcripts (both front and back),
(starting from 10th standard)
. Certificate(s), Diploma(s) and transcripts relating to
training in courses for computer/software programming
. Copy of Educational/Work experience evaluation report, if any;
. Copies of all experience letters for experience in IT . Try to
give as many documents as you can, including Offer letters, appraisal
letters, promotion letters, salary hike certificates etc., (if u are
having)
. Copies of 4 latest pay-stubs
. Copy of latest Resume
. Copy of Passport with I 94s(If already in US)
. Copy of SSN Card (If U have)

I have renewed my DL in VA while my H1B was pending last year (Oct 07) . All you need is your H1-B application receipt and they will extend it by 1 Year.

You could try to reopen the case with Supporting evidence of ill health and age. This is a long shot, but a good attroney should be able to pose a compelling argument. Also, try to get an infopass appointment and talk to someone about your options.

If so I appreciate if you can tell what kind of addition evidence they are looking for...I know evidence vary from case to case ..but anxious to know about...please hep me...

days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
On July 25, 2008, we mailed a notice requesting additional evidence or information in this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Sorry to hear that you are in this situation. It took about 8 weeks. Also one more thing, during this ordeal, I talked to an experienced lawyer who also said 8 weeks.

PD has to be current for the I485 to be accepted. For a dependent's application, Primary's PD is used. Bottomline, you will have to wait till your PD becomes current to apply for your wife. Most likely, the application will be returned.
