As far as I know, the 5 year wait period was until a couple years ago when the family based GC was backlogged. I got married in 2004 and had to wait until 2008 to file for GC, when my husband got his citizenship. At that time, our attorney advised this as the best course, since the priority dates were about 5 years out.
Filing for spouse falls under 2A of the family sponsored GC and currently the priority date for 2A India is 01 Jan 2010. In my estimation, you should get a GC within 12-18 mths.
But then again, I am not an attorney - so please consult one to validate this information.

NIW 140 approved last year. EB1a 140 RFE/485 pending. Can I file a new 485 for NIW? or do I have to withdraw the pending 485 before filing the new 485?

I am in similar boat. What does your lawyer say? I am waiting for my lawyer response. How about option on interfiling NIW 140 with the pending I-485. That is do not file new I-485 but change underlined I-140 in the old one. Ask your lawyer about that and let us also know whats his/her response.

Big thanks to the entire group. We should not be happy unless we get our goals done.

It all boils down to the relationship you have with the employer and how flexible they are w.r.t immigration policies etc.
I know of people who were involved from day 1 till they filed 485 and I know of people who were not involved untill filing of 485 had to be done.
Your case it looks like that employer wont tell you if he has an approved 140. If that is true then you will only get involved when your PD is current- to file AOS.

It seems to me, you are on a B1/B2 and are contemplating a marriage to a "485 current" green card benfeciary...and subsequently filing the 485 jointly with your would be other half...
The intention in a B class visa is very weak and its purpose very limited. It is best to not do anything while on the B visa, and relinquish the B status, then either re-enter on a stronger intent visa (H1/H4 or L1) and then file 485 or file the 485 from outside the country.
Any change of status from a B class visa is usually looked upon with a frown by the USCIS...
Even if you are not contemplating a marriage, but are already married for long but just happen to be in the US on a B Class visa, it is best to reliquish your B status, before doing anyting...

Just announced today is the new fujifilm S3 with its proported 12 MP sensor! It will consist of 2 "stacked" 6 MP sensors one for normal detail, one for highlights supposedly giving 4 times the dynamic range. The file output will remain 12 MP as was with the S2.

In my opionin, it still does not sound like a real 12 MP, rather an enhanced 6 MP cause all they have done is extended DR by adding a second pixel at each photosite. Now lets see how DR is actaully affected, claims of 4x DR are pretty large and tough to live up too! If the previous camera had 4 stops of DR that would mean 16 stops now? Nothing I've seen ever had that wide a range!

Hi:
I received RFE (employment verification letter) from USCIS, texas center two years ago. I was still employed by the company who filed my GC application at that time. So the company replied and my case status was updated. But my PD was not current, so my case is still pending until now.
I lost job recently, if my PD became current in early 2010, will USCIS EVL me again?
I know no one can predict how USCIS works. I just want to check if anyone had experience that was checked employment status twice?

Raise has nothing to do with GC processing.Decision of Raise Limit is set by employer and promotion does comes with change in job description.Keep one thing in mind Corporations make profit out of everybody whether its customers or employees doesnt matter.Corporations exists to make profits.by the way do you work for non-profit organization ?? in that case things are a little different based on finanicial availability.

If border guards have intelligence that -- let's pretend for a moment -- a university-age male student from Africa might be trying to engage in dangerous activity, then the border guards would be on the lookout for university-age male students from Africa. In contrast, university-age male students from, say, Malaysia, M�xico, Moldova, Monaco, or Myanmar would not be subject to the same scrutiny.

The only document that I know that suit the name " Unemployment Wage Report" is IRS Form 940-Employer's Annual Federal Unemployment (FUTA) Tax

The company's Tax Return also shows how's company doing financially,economically, if it able to pay their employees salaries and what business this company stated as her primary.
Therefore, I think, that asking for these docs seams as reasonable, keeping in mind that consulates and embassies belong to different department than DHS and USCIS.

I have changed my employment after I-140 approved. But the previous employer agreed to continue the GC process. I could not file 485 due to PD is not current.
The 6 yrs limit on H1 is about to be over.
Is it possible to extend H1-B after 6 yrs at the new employer, based on the I-140 approved by previous employer as green card is process? Or is it mandatory that I have to work at the employer who is processing my GC to get the extension on H1-B beyond 6 years?

In order to extend H1B beyond six years, you do not require to be with the GC sponsoring employer. One must have filed a labor 365 days before 6th year end date. 1 or 3 years extension is based on what stage of GC processing you are in. Hope this helps!

Is there anyway we could include EB immigration relief in the Economic Stumilus Package by bringing up creative pointers such as more greencards, more = small businesses, more greencards = more home buyers etcetera ? I see a faint chance here. With the urgency to kick start the economy, if we can get something on the bill, it will pass and will become a law fast.

I don't think that this is an option based on what I know of the the package. If you want to help your situation, PLEASE participate in IV's letter campaign if you haven't already done so. It will take 10 minutes of your time (as IV has provided various templates you can use, you don't have to write anything, just insert your information where appropriate) and $0.82 in cost (for stamps). This is one way we can all help ourselves.
