Like I said, the bill and hence the cut off date will only become effective on 10/1/2008 so if you can manage to get your GC by then, you will be just fine.
The merit system only becomes effective on 10/1/2008.
So what would one do if he wants to start applying for the LC or I-140 now ?

Could you please post one or two talking points specifically for this bill so that members do not confuse it with the other bills out there.
Yes a few important talking points would be useful. My understanding is most of the time calls are taken by someone to note the support of the specific bill number, so calling with bill number and some generic talk may be OK but a targeted talk to point out one or two points by all of us may have more impact.
BTW...I called Delahunt's office. First mentioned HR5882 and used a few generic talking points to request the congressman's support.

I had emailed Houston consulate 3 times and every time got a reply saying No ATV required. I had a printout of the emails with me, incase they asked me about ATV. If they would still not allow me, there was nothing that I could do other than rescheduling the travel and going to Chennai for a ATV.

I am thinking to do Masters not only for GC but also to make progress in my career. My EB3 PD is Jan 2006. When I would finish MS, I can port my Jan 2006 to EB2 category.

Just getting a MS degree won't bring wonders in your field. I am telling you with first hand experience of mine
But there are advantages of doing onsite MS in US:
It gets you to US if you are already not in US:---> But coming to USA on H1B is a better deal instead of coming here on F-1. But again H1B is now lottery susyem now
You may enjoy the college here while doing MS but again it is a costly proposition
Other than this there is absolutely no use of MS when it comes to IT field in particular. MS is a vehicle which you can use to get into some specialized filed like chip designing, biotech etc etc but for IT not very uselful.
Also, in the long run having a career in accounting is a far better idea than having a career in IT.

It is based on the date on the envelop. Usually such letter are sent using the confirm return receipt.

45 day letter was sent by DOL on 3/7/06.
Lawyer received it on 3/14/06.
Lawyer sent the notice to my HR on 4/10/06 (after sitting on it for almost a month....am VERY upset with the lawyer...but, that is another story...HR is following up with the Lawyer on their delay).
HR responded to the Lawyer on 4/10/06.
HR is also following up with the lawyer to ensure it gets sent out ASAP as the deadline is 4/21/06
Question: How do they determine that the response has been received in a timely manner? Is it based on mail receipt, or them actually entering the data to continue with the case before 45 days are up?

Hey,
We just saw "Card production ordered" status change on our 485 applications.
So this proves that TSC is indeed processing 485 apps.
Our 485 apps were originally filed with TSC, then transferred to NSC in Dec 2007, again transferred back to TSC in Apr 2008.
Its been a long wait!! Hopefully we see a lot of approvals for people stuck in this for a while.

The existing applicants challenged it in court and won the case.
Also a memo has to support INA as well as AC21 laws. If the memo contradicts INA or AC21 then it can be challenged in the court because only lawmakers have the authority to change laws and no other organization.
I think if the interpretations of this memo are taken seriously , lot of people on AOS only status will be in trouble and this can cause hardships. A lawsuit will be the only way out. Remember if it was not the lawsuit , July 07 filers would not have been able to reverse the bulletin.

Here's my understanding, if you entered US using Advance Parole then you are safe and need not to worry about anything, But if you entered US using Non Immigrant visa, like H,L or F then once you get the adjustment of status , you have to either renew your H1B (so you will get the new I-94 ) else go out of the country and come back using AP before the expiry of I-94.
This rule has been there since long long time.. the legal status in the country is always determined by the I-94 .. thats it, If your I-94 is expired go out and get a new one.
But the issue now is like my situation where, I entered the country using AP but later switched back to H1B and then changed the job and got a new H1B with new I-94. The question is which I-94 will be considered valid, the one I got a POE which Paroled or the new I-94 got with H1B?
