I believe all these bills are in response to Bill gates addressing Dept. of Science and Technology last week though he mentioned EB issue he only faced a deaf ear from chair and he stressed a lot on H1B despite of lot of opposition from reps.

You should be allocated a visa number if nothing is wrong with your application... If its quite old as it looks to be, they may issue an RFE for EVL.. and you can respond asap and still be optimystic.. Chances are high that you'll get a Visa number assigned to you if the quota doesn't finish in the first week of March... Actual approval can come months later even if the PD has retrogressed...
So chill and prepare for EVL or straight approval...

Though my PD is quite old , I didn't get to my I-140 filing until Jan 2007 thanks to the labor certification backlog hell. It was filed premium and approved in Jan 07 itself. And also my I-485 was filed in last week of July. So the information USCIS has is kind of recent. And I have stayed with the same employer so far (One of world's well reputed & largest IT company)
I hope they look at these facts and dont bother sending an RFE or EVL and send me the straight approval ! (Fingers crossed and touch wood and whatever else !)

They might thinking to deport you asap!!!!!!!! Just kidding!!! I dont have much hope from these guys. My finger print medical expired last year and I didn't get any letter or call.
Anyway having + Attitude and is good thing.
just wondering, how do you know when your medical and FP expires ?
I hope they will ask us to go through that pain only when they are about to approve a case (just imagine the mess ..if GC takes 10 years and they ask to go medical every 2 years)

I agree, support from any org or forum is good for our cause and would definitely broden our support base.
I have seen couple of postings from 'gc_2010', they sound negative, it is better to ingnore them rather then taking pains to clarrify those postings.

I know this topic has been discussed in other threads as well and those threads got buried over the Period of time but this is getting beyond limit now - let me know if anyone has any good idea or if we can do anything together......
My PD is EB3 Mar 2005 and my 140 is applied in EB3 May 2007. at NSC (Nebraska) Its been 13 months and no signs of movement and no one is helping . Here what I did on a personal level and here is what i heard.
a) Contacted USCIS - they said contact employer/lawyer because they are the beneficiary.
b) Contacted Lawyer - they said 'Pls wait for some more time' & then ask employer.
c) Contacted Employer - they said that we can't push lawyers unless your case is passed 2 months from Processing Date update.
d) Contacted Local Congressman - Told them that the Processing Date update is a farce and USCIS (NSC) moves them back n forth just to save their Face. This is really unfair for a certain category of peoples. They took my case no. and inquired and then said that since you have a parallel H1B and a job - we would wait. If your existence in US comes on the Line then we will Jump in and help you. We are sorry but we can't really expedite unless a emergency comes.
Now tell me folks what other options we all have - NSC is just messing with EB3 140. Whatever is the workload this can not happen. Do we still have some options to work on (apart from sitting idle and pray) ?

You have an approved I-140, so the PD belongs to you.
Find a job that requires either an MS degree or BS+5 years experience (this could very well be your current job). File a new perm. When it's approved file for a new I-140 in EB2 attaching the copy of the old approved I-140 asking to capture that date.
Then attach your new I-140 with EB2 to your existing I-485 application.

My wife went on Jan 17th for h1b stamping in Chennai. It was cool. She is doing her residency in a non profit organization. The VO was cracking jokes, saying "You do internal medicine for humans whereas your husband does internal medicine for computers".
I heard they are pretty cool these days. But make sure to take all your w2s and payslips and also make sure you tell him/her what you do and that has to match your petition, he may ask, how many years u r in US, how many children etc....
If anyone had bad experiences in recent times, please let us know.

I am under the impression that atleast in Illinois, the local law enforcement (police) CANNOT ask for the legal status or check any documents if it is a routine traffic stop or just pull you over and then ask for the documents. I know for a fact as this had become a big issue at one of the Chicago's northern suburbs recently and was in news for quite some time. There were two sections of citizens who wanted police to check and others (ACLU) argued that legal status was a federal jurisdiction and the local law enforcement were not authorized to check and violated the rights.
I think only ICE or CBP can ask that and how many of them are around in cities/ towns far away from the border?
I assume the same is true with other Police Depts.

If you want to elicit a response on retrogression, then you have to call their office and ask to speak with the person that deals with immigration issues and policy.
Or you can seek an appointment with that person and see what they have to say about this. Writing a letter will get you a generic form-letter response from a junior staffer whose job is to pick one of the 25 form-letter responses based on issue (Iraq, healthcare, immigration, veteran's affairs, crime, gun-control, abortion, judicial appointments, taxes, etc. etc. etc.) and slap your name/address and stick a postage stamp and mail it.
So, if you want to talk about immigration with them, call their office. Talk on phone or seek and appointment and meet them to elicit their position and educate them on retrogression.
