i have gotten everything from multiple !@#'s to great but that is not the point. Your profile is empty, there is very little information about you and the first thing you post is something about how H1's getting scammed. To me it would look like a post from an anti immigrant basher trying to muddy the waters. How does this post help any one?..you could have just added it in the news section. Was this article so important that you had to create a dummy profile and post something. You were in such a hurry that you could not be bothered with entering some information about you...isnt it strange...maybe you are normal guy who just read something during your lunch break and wanted to share it with everybody...who knows... A first post could be something like...'i just joined, i have a PD of xxx and i would like to help' would'nt you agree that this is much better than posting something that doesnt help the immigrant community.

I will need in total 13 years to get a green card, even though I am employed in high skill job!
I applied for green card in July 2006 under employment based category 2 (EB2-India), which is only for the people employed in a high skill job. There are more than 25,000 people waiting in this category and the annual quota is only 3,000. At this rate, I may get visa after 10 years or 13 years in total!
Furthermore, I am restricted by law to work in the same or similar job category till I get green card. So on one hand the category wants bright people but on the other hand it stops that bright person from advancing in the career for not 1 or 2 years but 13 years!
How human is it to make a person and his family who has been in this country for last 10 years, paid taxes on time, has no criminal record, and employed in a very high skill job wait 13 years to get a green card so that can start a normal life?

All your friends who got 221G are not telling you the truth. Was all their paperwork complete and ok? Probably not. No friend will admit their mistake and fraud. So they are telling you half story and blaming it on others. 221G is a good thing. It shows government is looking at possibe fraud and security risk seriously. National security is very important and highest priority for us living in US. H1B visa as a whole got a bad name due to fraud. It is not just employers but employees are also responsible for it. Employees are not illiterate or dumb to not understand any fraud. I wish more serious work is done by the government on every greencard application. If the system has clean cases, no anti-immigrant will point any finger and say the whole H1B system is bad.

there remains a sliver of hope- its called the lame duck session when a lot of such measures are passed. post election, everyone feels "safer".
a marked up bill, ready for the house, could sneak through in the post election season. we have to keep trying!

I hope USCIS explains to us on how their work distribution process works.
Forget about that even if they publish every quarter, how many I-485 from each country of chargeability and employment categories are pending any processing, it will help analyse when one can expect their approval.
At this moment TSC is following some Pilot plus program to adjudicate the I-140 and I-485 filed concurrent, that scrwes up many standalone I-140 for whom the PD is not current. According to USCIS policy your I-140 adjudication is independent of the country of chargeability and PD. Now how in the world we explain their Pilot plus program which ignores the I-140s from the retrogressed countries is only USCIS leadership knows.

EB2 or EB3?
Hello,
My I-140 got denied based on my Education.
I have 3 yrs + PG Diploma which is equivalent to US Degree according to my education evaluation.
Experience:
- 6 yrs of OUTSIDE USA experience
- 5 yrs of USA experience including 2 yrs of experience with current company.
- I am working as FULL time with an American Company at present
The JOB Description for PERM was:
"Bachelor�s degree in Computer Science plus 5 years experience; 3 year Bachelor�s degree plus 2 year post-graduate diploma in Software Engineering and 5 years experience acceptable. "
Gurus, please help me providing some info, if there is any chance of getting it approved if I file a Motion.. or what should I do next?

This new proposed rule will not matter for retrogressed categories / countries.
It will affect the lucky few whose PDs are current and can file concurrently. It certainly looks like they are enforcing (FORCING) premium process I-140s down everyones' throat now. It is a very typical dirty ploy from this administration.
Think twice before you talk about corruption and bribes in third world countries. We all know how this system 'works' now...

Ok I think we are reaching new heights of RIDICULOUS here. An IV member has asked a SIMPLE question about whether or not an Indian citizen needs a visa for the Bahamas.
Who the heck do we think we are to ask him/her to NOT go on that cruise and instead donate to IV?? People i know that we need to raise money and quickly, but this is really not the way to go about it. Everyone needs a vacation to recharge their batteries and spend quality time with their families. The GC is a "MEANS to the END", NOT "The END". Going by this logic, lets not do anything for the next 2-3 years. Lets not buy houses, cars, furniture etc. Lets instead contribute to IV. Besides what is to say that this person has not contributed to IV already?

Just a note, applications were accepted till 17 August, 2007.
This thread is started to just gather the list of people who have approved Labor as on 31st Jul,2007 and could not file I-485 for various reasons like out of country,Not married, Employer did not file or Lawyer delayed etc.

But at least they are getting GC in 6 months. I dont mind getting paid low if it means getting GC in 6 months. Anyways half our money goes in getting h1 extensions and paying lawyers so might as well get it over with by getting paid low. It is so disheartening to know how people are abusing the law and getting GC the short cut way while our stuggle starts with getting admission to f1 to doing our masters to trying to get h1 and then GC.
I have a friend who has done his MS from a top school here and his wife is a dentist but cant work for last 5 years and here is a guy whose education is a BCom and his wife's too and both are working and have got the whole thing the easy way out. Very disheartening.

I totally agree. We need to push for a USCIS SOP change where you should be able to add your spouse even when you PD is not current. Like in my situation, my wife is outside US and unfortunately cannot come back till Sep 21 (F1 --> H1 Stamping) issue.
Earlier, we never had this issue because PD was predictable and only allowed folks who were very close to their PD's. Now with this fiasco, no one is sure how uscis would process the order of applications and there is a greater risk that your application might be approved before your PD on the basis of RD (Receipt Date)

The government's surprise offer, then abrupt reversal, of an opportunity for thousands of skilled foreign workers to obtain permanent residency in the U.S. highlights the problems of the overtaxed immigration system and the frenzy that results from a chance to apply for a green card.
The scramble has put tens of thousands of workers and their families in limbo after many of them and their employers spent thousands of dollars in hopes of securing permanent residency. It may result in a class-action lawsuit against the government by frustrated applicants.
The problem began on June 12 when the government seemed to open the door for thousands of foreign workers and their families to end the long wait to apply for a green card. That is when the State Department published a Visa Bulletin, which is a monthly notice closely watched by immigration attorneys and their clients because it determines who is eligible to file a green-card application the next month. The June bulletin announced that practically all skilled foreign workers who had been previously deemed eligible for an employer-sponsored visa could now take the final step of applying for a green card.
By law, the U.S. can issue about 140,000 employment-based green cards each year. Last year, the government fell short by about 10,000, despite the long waiting list; leftover visas cannot be rolled over to the next year. The June announcement aimed to prevent the visa slot from going to waste, according to a State Department spokeswoman.

The announcement was greeted with a mix of jubilation and panic by thousands of engineers, lab scientists and other high-skilled foreigners who had waited years for their place in line. Many of their dependents boarded planes for the U.S. to meet a requirement that all family members be present at the time of filing.
"The bulletin created a land rush among legal immigrants desperate to finalize their green-card applications," said Steve Miller, a Seattle-based immigration attorney.
Then, on July 2, the State Department issued an "update" that reversed the previous bulletin. It stated, effective immediately, there would be no further authorizations for employment-based cases. The U.S. Citizenship and Immigration Services, which processes the applications, said it would instead simply process existing applications to meet this year's quota. "We already had sufficient applications pending without new applicants...," a spokesman said.
Mike Aytes, head of domestic operations for the USCIS, said all 147,141 employment-based green cards have now been issued for the year.

How abt ur exp letters.Do u submit one if so maybe the format or something
also since its a govt organization, my LC juz said 4 years bachelors or equivalent. i do have a Masters from an US state university. so not sure what could be the RFE.. ability of pay is not an issue i guess, cos its govt. what other rfe's are there?
