I am also in same situation. Two 140s (eb2 and 3) both have same PD. Have beed trying for interfile from last one year. I do not know if my case is eb2 or still in eb3. I enquired from Congressman and she told me that my case is assigned to a IO on 6th Aug so its in eb2. She is not listening to anything else after telling me this information. I have infopass on 2nd Sep. lets see ...

Hi Folks,
I had been to canada to get my Visa stamped for my 7th in March'07. At the time i was entering United States, the immigration officer did not issue the I-94 to the validity of visa since my passport was expiring on Oct 27th 2007. I have a valid visa until April 2010. The I-94 attached to my passport is expiring on Oct 26th 2007. Do i have to renew my I-94 without fail? Or should i just an new I-94 next time i go out of the country and come back?

YEah i did get my passport renewed rigght after i came back from Canada.
However i totally forgot about my I-94.
So you think the only way to get the i-94 extended is to go out of country.
Even i heard about getting I-94 renewed from major international airports. Does anybody has any further information related to this?

Good it all worked out for you. I am sure they stamped your passport on the way back into USA. Just keep track of your intrnational travel at some point it might be required, you might loose track of them if you don't have exit or entry stamps on your passport.

I did not have a exit date on the passport. At the border they just took my Old I-94 and let me go. But when i came in I got the admit stampted. I hope its not a issue right?

People travelling to India, especially from the West coast should fly via the Pacific. Asian airlines such as Thai, Cathay and Asiana all offer better fares, better service and faster transit times.Plus these countries are not trying to fleece people by requiring that they get a "Direct Airside Transit Visa". It happened with my family when they reached the airport to board their flight on Virgin , they were not allowed.I then bought tickets on Thai for the next day. To compound the pain, Virgin imposed a "No Show" fee on each ticket despite going to the airport. I think it would be best to avoid most European carriers, if for no other reason but they offer higher fares, terrible service, long transit times and last but not the least; the scam of the century(Airport Transit Visas). What do they think the passengers will try to do, jump off the walkway and make a run for it so they can settle illegally in U.K!I think the U.K govt is running out of ways to make money so they have found the most ridiculous way to make a few extra pounds from people foolish enough to travel on one of their carriers! DONT FLY VIA U.K. PERIOD!

Thanks. My lawyer was worried to file I485 as derivative due to the fact my primary application is considered withdrawn. So he made a request in letter to adjudicate together instead of filing another 485. I guess i have to wait.

Interfiling is essentially the transfer of a pending I-485 application to adjust status from one I-140 petition to another filed for the same beneficiary. Examples would be when there is a successor employer, or an I-140 petition filed by a new employer or with the same employer based on a new and different job offer. This eliminates the need to re-file the I-485 in many situations, if there is a second I-140 petition to support the pending I-485.
So if your second I-140 is approved you'll be able to interfile if you want to but I do not see the problem with filing the second I-140 while one is already pending.

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

One of friends got advice from a tax consultant about the 401K withdrawal question you have. The best approach in this case would be to phase out the withdrawal amounts over a period of successive years. When you are in India, you are not earning US income. So say if you take 10K the first year, it will be considered income earned in US for which you have to pay tax. Since 10K is below the standard deduction amt, you will not have to pay any tax. The penalty will still apply as you are breaking the 401K.

I have called him for issues a number of times not related to AC21 and he answers all phone calls. In fact, I called him atleast 4 times before I actually handed him my case. RK on the other hand charges per second. I paid him 600$ for a 20 minute phone call and he did not tell me anything i did not already know....Rip off!!

I got my Wife's and son's passports renewed at NY. I printed the phtos on the computer. My wife's i mailed it(got it back in 1 week). My sons i went to NY. If you go before 11AM, you can collect it back same evening. I did this almost 18 months ago.

I have gone through interview and it is nothing to worry about. They are just distributing the workload. IO will check your documents etc..and then will issue GC if visa is available or throw it into storage like mine.

Okay. I was able to talk to my attorney just a few minutes ago. He said, to do interfiling , you do not need to have PD current based on new I-140 as this is just a case update with new 140 information. He said that in any case, your 485 will be picked based on PD. I found him very very confident when he was telling me all this info to me.

Then I would produce that.. As I mentioned in previous posts, I also attached other offers and contracts I had from before.
Also lawyer wrote 1 letter specifically addressing the work location and nature point, which had client name, contract, and info about job.
I don't remember seeing any specific time limit mentioned in that letter.
End client varification letter will help. In my case, we didn't attach it since it was too much hassle to get one.. but lawyer wanted to add it if we could get it..
We had total 4 client contracts with my name on it.
plus 10 other contracts for work without anyone's name on it.. since we do projects not staffing only we could do that..

Do we need to send end client 'project verification letter' or something like that ?.

SO if USCIS wants to make a new rule of filing I485 for the one whose I 140 is cleared and priority date is not current, It CAN DO That RULE Right?
