Guys, This is a mirage. Now that USCIS relaized last year they wasted so many visas they are reacting, and making everything current. will make a big back log. in few months.. This will now remove our eye from the ball for reform. WE should not lose sight on the bigger goal.

This is not really stopping any fraud. But diverting money to border security. If they really wanted to secure the border and wanted to stop fruad, they should have created a bill that imposes heavy fines on employers employing undocumented workers.
It would have stopped not just illegal immigration and also secured the borders with the money. But no politician has a backbone to punish American Citizen employers employing illegal Hispanics. They cannot risk losing American citizen industry votes and money and Hispanic votes.
They can do away with Desi body shops and Desis because they how divided desis are and fight with each other.
That is right. We are divided, fight among ourselves, boast that we are highly skilled and highly paid, boast that we are big time contributors to USA, fastest growing community.... huge number of doctors, engineers, scientists ....... but we are divided. We keep fighting among ourselves. We form thousands of associations like ATA, TANA, Tamil association, Gujarati association ........ the list goes on but we can never unite among ourselves. Thats why we get treated like shit and most of us accept it as part of lives. It is always that some people try to do something to make a difference only to be opposed by our own people.

Well..customer service people at USCIS may not be very informed with the procedures. In the past when i have queried them on procedures pertaining to July2, they have come up with widely varying answers from one rep to another. The only thing they can be depended upon is when you have case number, they can check the satus, or perhaps dig your case number from the system, or othe specific details...!! That has been my expeirence so far!
My I-485 application was received on July 2. When i met the infopass people, they said that USCIS had requested my file from Laguna storgae facility on July 17th. The NVC had no such information, when i called them subsequently.

The reason why so many EB2/EB3 based GCs were approved in years 2003/2004/2005 was because USCIS simply did not get a handle on the 7% country limit and messed up enforcing the limits. If someone thinks that all those excess immigrant visas were issued only in the last quarter when visas from other countries went unused (AC21), they are totally wrong. It was the main reason why USCIS made the visas 'Unavailable' because they simply did not know the extent of the damage.
Also, everyone seems to be forgetting that the reason the country quotas exist is for controlling the ethnic demography of this country. Like it or not - This country does not like immigrant population to be skewed too much to one particular ethnic group, be it Chinese or Indians or some other group in future. And this consideration would definitely be playing on a Senator's mind. Besides it has not escaped the attention of the Senators/Congressmen that the AC21 provision resulted in giving more visas to Chinese/Indians than any other country.
At this moment, its really hard to predict by how much the visa backlog will ease. One has to keep in mind that the current bills really go a long way to ease backlog and to increase per country quotas. Not counting the dependendents in the employment category is a key consideration and will definitely improve the situation. Not to mention increase in visa numbers from 140,000 to 290,000. No one really knows what would be the impact of STEM related GCs.
And if someone is arguing that by keeping the Paragraph (5) provisions, stipulated by AC21, one is going to solve retrogression - I don't buy it. Because as of today that provision is active and it hasn't helped solving the backlog. And the Senators are certainly not looking for ideas to open the floodgate and give GC to everyone who has applied the day before. Lest not forget their constituent considerations and megaphones of people like NumbersUSA.
At this moment, our energies should be more focussed on getting whatever EB related provisions in the bills passed through the senate without them getting dropped. I propose that IV support Bill Frist's bill rather than the committee bill since the illegal immigration amnesty would only add to the woes of the legal immigrants. Lets not forget the 245(i) nightmare.

I am in the same boat, my wife is travelling to our home country next month for a job interview and I am awaiting till the end of teh school year then I have to be ready 2 go back if things does gont go well regarding the eb provisions.
Days were so depressing after Oct. Bulletin was released. Even considered going back to home country atleast 1000 times. Good to here some good news. At least i see some ray of hope. Core members you have made my day.

many IV members very badly underestimate the support for the undocumented immigrants among politicians. This strength of support is based on vote bank politics andand money power. If it is a simple logic of doing the fair thing, doin the right thing for the country etc, we could have achieved legislative relief for retrogression in Dec 2005.
Their lobby has consistently undermined our efforts last two years,and they will contunue to do so in 2009 since democratic party will have even bigger majorities in Senate and the House.

Assuming SA2238 passes... It will be the end of 'Contracting' for all practical purposes. A bonaza for outsourcing companies! Lots of projects and positions are going to get outsourced. Some projects may be moved off-site, as in big contracting companies doing actual work in their premises, some will go to India. some H1Bs may be lucky to be hired as "direct employees" by the clients, those who can will switch to EADs (which don't have such restrictions). For others, it'll be the end of the road.
so what does this mean now? I have little less than 3 yrs left on my H1b and I just started my GC process. Does that mean once I finish my 6 yrs, getting an extension will be a problem? Again I am assuming SA2238 will go through by that time....
Also, I have heard that in california H1b extension beyong 6 yrs is being rejected already stating that you cannot sub-contract on H1B
